Pay your employees correctly or risk extensive penalties!
A baby and children’s retail outlet in Victoria, Baby & Kids Pty Ltd, has been investigated by the Fair Work Ombudsman after receiving a request for assistance from a worker who was employed by the company in a full-time e-commerce role in January to October 2022.
The worker’s duties at the business included processing online orders and customer service for the company’s online shop. Originally the worker was based at the store before working from home full time. When the worker left the business, she was not paid for her final two weeks of work nor was she paid her accrued but untaken annual leave entitlement.
Fair Work issued a Compliance Notice whereby the employer was required to pay the worker $4,374 plus superannuation. The business allegedly failed to comply with the Compliance Notice and as such, the Fair Work Ombudsman is now seeking penalties of up to $41,250 from the business and $8,250 from the business owner. The regulator is also seeking an order for the company to pay the alleged amount owing to the employee, plus superannuation and interest.
